Foley Considers Temporary Moratorium on High-Demand Data Centers and Crypto Facilities

Foley, Ala. — (OBA) —  High-tech developments with heavy utility demands may soon face a pause in Foley as city officials evaluate new regulatory standards. City leaders are considering a temporary moratorium to manage rapid development and protect local water and power resources. The proposed hold will give municipal departments time to assess the long-term infrastructure impacts of tech-heavy facilities.


The joint regular council meeting and work session will take place this afternoon/evening, Mon, Aug 17, 2026, at 4 PM in the Council Chambers at Foley City Hall.


A major highlight of the meeting agenda is an ordinance imposing a temporary moratorium on applications for data centers, cryptocurrency and Bitcoin mining operations, server farms, and similar technology-oriented facilities. Council members will consider a first reading of the ordinance and a resolution to schedule an upcoming public hearing on the matter. Officials cite concerns about the extreme electrical demand and high water consumption typical of these high-density technological operations.


During the meeting, the council will also:


  • Hold a public hearing and consider a resolution declaring weeds, junk, trash, and litter a public nuisance at 407 Cedar Court and authorizing city employees to enter the property for abatement.
  • Present a proclamation honoring Commissioner Chris Blankenship.
  • Review departmental statistics, monthly permit reports, and paid bills for July 2026.
  • Hear second readings of ordinances establishing fees and policies for the Foley Activity Center gymnasium and updating speed limits in Bay Forest Estates and the Wolf Bay Point Subdivision.
  • Consider an ABC license application for BJ's Wholesale Club at 3269 Palm Beach Way, including lounge retail liquor, off-premises beer, and table wine.
  • Discuss a contribution to the Kiwanis Club of Foley Foundation to purchase replacement reindeer for the Foley Christmas Parade.
  • Consider accepting Goodwyn Mills Cawood's proposal to develop a Municipal Complex Master Plan.
  • Review accepting the FY26 Legislative Event Grant, a donation of K9 Trauma Kits from Protecting K9 Heroes, and unbudgeted donation funds for the Foley Fire Department.
  • Consider declaring Sgt. Randy Stallworth's badge and service weapon surplus.
  • Discuss waiving event and rental fees for the Women's Care Medical Center Walk For Life Walk-A-Thon at Max Griffin Park and for the Foley Little Lions at the Foley Civic Center.
  • Consider purchasing a new FEL commercial sanitation truck and approving a budget amendment to host the 1st Annual Gulf Coast Equipment "Roadeo" Hospitality Night.
  • Discuss approving The Frazer Lanier Company, Incorporated, as an investment banker for general obligation warrants.
  • Review a $10,000 contribution to the Blankenship Scholars Program at the University of South Alabama.
  • Consider authorizing the mayor to sign a letter of intent for the Street Department regarding triaxle dump trucks.
  • Set public hearings to declare weed nuisances at 3094 Gallica Lane and 0 Co Rd 20.
  • Review monthly bid awards for July 2026, real property purchases on East Rose Avenue, and the adoption of the annual transportation plan under the Rebuild Alabama Act.
