Driver Indicted After Fatal Scooter Collision in Foley

Foley, Ala. — (OBA) — Two young men from Guatemala lost their lives in a traffic accident earlier this year in Foley, and the driver involved is now facing charges. The Foley Police Department has released details following an ongoing investigation. Officials said the deadly collision involved a motorized scooter and another vehicle. The case went before a Baldwin County Grand Jury.


The crash happened on April 13, 2025, at the intersection of County Road 65 and Airport Road. Authorities said 19-year-old Brandon Esquivel Palencia and 18-year-old Cesar Villatoro Chavez were riding on a small motorized scooter when they were struck.


The vehicle was allegedly driven by 21-year-old Christopher Sanchez Mendoza. Police say the impact killed both Brandon and Cesar. The accident was investigated by Foley Police with all findings presented to the Baldwin County Grand Jury for review.


On August 27, 2025, the case was presented to the grand jury, which handed down an indictment against Mendoza. He was later arrested in connection with the crash. Officials say he now faces a charge of Criminally Negligent Homicide, which is classified as a Class A misdemeanor under Alabama law.


Foley Police confirmed that federal Homeland Security authorities are also aware of the matter. They are currently handling legal processes connected to the case. Meanwhile, the Foley Police Department noted that the investigation resulted in coordinated efforts between local and federal officials.
